Terms and Conditions of Sale for Retail Sales by Mac Tools
1. Offer and Governing Provisions.
Mac Tools is pleased to offer for sale tools and equipment manufactured or marketed by Mac Tools ("Products") and Mac Tools branded clothing and accessories ("Apparel"), subject to the following terms and conditions. The Customer's placement of an order for Products and/or Apparel constitutes the Customer's unconditional acceptance of these terms and conditions. These terms and conditions are subject to change without prior written notice at any time in the sole discretion of Mac Tools.
2. Items Sold for Personal Use, Not for Resale.
Mac Tools are sold primarily through a network of independent distributors, although tools may also be offered through authorized retailers. Because Mac Tools’ distributor network may not reach all potential customers, Mac Tools has elected to offer tools for direct purchase from Mac Tools. By placing an order, the customer agrees that such customer is purchasing tools for the customer’s use, and not for resale. Persons interested in becoming Mac Tools distributors should contact Mac Tools for information.
3. LIMITED WARRANTY for Products.
Mac Tools warrants to all Customers who purchase Products from authorized Mac Tools distributors, authorized retailers or directly from Mac Tools that such Products will be free from defects in workmanship and materials for the warranty period identified in the product literature for such Product.
Warranties for particular products may also be found in the product information posted at www.mactools.com
. Mac Tools will, at its option, repair, replace or refund the purchase price of any item found to be defective in materials or workmanship during the applicable warranty period. IMPORTANT – PLEASE NOTE THAT THIS WARRANTY DOES NOT COVER DEFECTS OR DAMAGE
This warranty also does not cover parts, such as O rings, that wear, or consumable products, such as drill bits, saw blades, grinding discs, sanding discs, knife blades, files, O2 sensors and batteries. Mac Tools may charge for the replacement of these parts or consumable products
- after the warranty period expires
- if the Product was not originally purchased directly from Mac Tools or an authorized Mac Tools distributor or retailer;
- from repair services not performed by Mac Tools or an authorized Mac Tools distributor; or
- arising from accidents, tampering, modification, misuse, abuse, or failure to maintain.
4. NO WARRANTY for apparel.
Mac Tools hereby disclaims all express and implied warranties for apparel.
THE ABOVE WARRANTIES GIVE YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM COUNTRY TO COUNTRY AND STATE TO STATE. IN THE U.K., NOTHING IN THIS WARRANTY WILL AFFECT YOUR STATUTORY RIGHTS.
5. WARRANTY SERVICE.
Mac Tools Customers who purchase products from Mac Tools Distributors should contact their distributors to obtain warranty service. All other Customers should contact Mac Tools for warranty service.
To obtain warranty service, return your Product, together with proof of purchase and a written statement identifying the product you are returning and briefly describing the reasons you think the product is defective and providing your name, address, telephone number, date and place of purchase, to Mac Tools at:

If upon review Mac Tools determines the product is not under warranty, Mac Tools will contact you to determine whether Mac Tools should repair or replace the product at your expense, return the product, or discard the product. If you do not respond within thirty (30) days, the product will be discarded.
By repairing or replacing a Product, or providing a refund, Mac Tools does not waive a claim that a Product has been subject to abnormal use or misuse.
Mac Tools strongly encourages you to send returns with a tracking number or delivery confirmation number. Mac Tools recommends that you (1) use a carrier that offers shipment tracking for all returns and (2) either insure your package for safe return to Mac Tools or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. Mac Tools is not responsible for lost or damaged returns.
If you choose not to (1) use a carrier that offers tracking or (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping. Replacement or refund will not be issued unless a valid proof of delivery can be provided.
6. Non-Warranty Returns.
Mac Tools will accept the return of any unused Product or Apparel purchased directly from Mac Tools within thirty (30) days from the date of purchase. Products and Apparel must be in the original packaging, in new, resaleable condition. Apparel must retain all tags. Software packaging must be unopened. Gift Cards are not returnable for a refund.
7. Repairable Products.
Certain products carry a Mac Tools Repair Warranty. These products are typically Air Tools and limited Electrical Tools. We have developed a Flat Rate system to ensure that every tool entering the repair department is thoroughly checked and repaired to the manufacturer specifications (subject to normal tool operation). Mac Tools offers a 90 day limited warranty on all repaired products.
8. Notice of Product and Apparel Design.
- Customer pays for shipping cost to Mac Tools Repair Facility.
- Mac Tools will repair your tool to Manufacture Specifications and return your tool to you. Mac Tools reserves the right to replace your tool if circumstances warrant replacement.
- You will be charged the Flat Rate price and Mac Tools will pay for shipping back to you.
- In the event the tool received falls under the manufacturer’s warranty, it will be repaired and returned to you at no charge.
- In the event the tool received is damaged and cannot be repaired under the flat rate system, you will be notified via email or telephone with an estimate to repair or replace. You will have 30 days to accept or deny the estimate. If denied or there is not a response, your tool will be returned to you unassembled for safety reasons and your credit card will be charged for shipping the tool back to you

Mac Tools reserves the right to make changes in design or construction at any time without incurring any obligation to incorporate such changes in Product and/or Apparel previously sold. Mac Tools also reserves the right to discontinue the manufacture or offering for sale of any Product and/or Apparel at any time.

WARNING: Brass products contain lead, a chemical known to the State of California to cause cancer and birth defects (or other reproductive harm).
10. Safety Information.
Safety begins with the user. Mac Tools is committed to helping you get the job done efficiently and safely. Learn how to use your tools properly. Take precautions to eliminate personal injury and costly damage. Unsafe hand tool use can cause on-the-job injuries. Safe tool use prevents accidents and prolongs the life of your tools. Damaged or worn tools must be discarded and replaced for your own safety. Important proper tool use and personal safety information is contained throughout the Mac Tools website.
